Terms & Conditions

Introduction

These Terms and Conditions (“Agreement”) govern the relationship between The Tourwala, a premier travel agency offering luxury and adventure group tours, including customized home-to-home experiences, and you (“Client”). By accessing or using our services, you agree to be bound by this Agreement.

1. Who We Are

Thetourwala is a professional travel agency specializing in luxury adventures and personalized group tours. Our services include seamless home-to-home travel arrangements, exclusive access to luxurious accommodations, curated experiences, and special attention to client preferences for an unforgettable journey.


2. How We Work

We have meticulously designed our approach to ensure that every Client enjoys a seamless, luxurious, and personalized travel experience.

  1. Inquiry and Consultation
    • The process begins with a personalized consultation to understand your preferences, interests, and requirements.
    • Our experienced travel consultants provide tailored recommendations, ensuring that each itinerary reflects your unique desires.
  2. Proposal and Customization
    • Once your preferences are noted, we provide a detailed proposal that outlines the itinerary, accommodations, activities, and costs.
    • Clients may request revisions or add-ons to the proposal to better suit their needs.
  3. Booking Confirmation
    • Upon approval of the final itinerary, the booking is confirmed with a non-refundable deposit (outlined in Section 3).
    • All arrangements, including flights, accommodations, and activities, are then secured by The Agency with our trusted Service Providers.
  4. Pre-Travel Coordination
    • A dedicated travel concierge will assist you with pre-departure preparations, including documentation, packing tips, and travel advice.
    • Final travel documents, vouchers, and contact information for on-ground representatives will be shared at least 7 days before departure.
  5. Luxury Travel Execution
    • On your travel day, our team ensures a seamless door-to-door experience, managing everything from airport pickups to luxury check-ins at your destination.
    • Our on-ground team remains accessible 24/7 to address any concerns or make adjustments during the trip.
  6. Post-Travel Feedback
    • Upon your return, we actively seek feedback to ensure continuous improvement of our services and build lasting relationships with our Clients.

3. How We Approach These Terms

To ensure a clear and transparent relationship with our Clients, we approach these terms with the following principles:

  1. Transparency
    • We believe in providing our Clients with detailed and accurate information at every stage of their journey, from booking to execution.
    • All terms, costs, and conditions are clearly communicated upfront to avoid misunderstandings.
  2. Client-Centric Policies
    • Our policies are designed to prioritize Client satisfaction while maintaining fairness and efficiency in operations.
    • Every term in this Agreement has been crafted to balance Client convenience with the realities of organizing luxury travel experiences.
  3. Fairness and Adaptability
    • While we operate within well-defined guidelines, we understand the dynamic nature of travel and strive to remain flexible wherever possible.
    • In unforeseen circumstances, we work diligently to provide suitable alternatives that align with the quality and luxury standards of our brand.
  4. Commitment to Excellence
    • By adhering to these terms, Thetourwala ensures the highest standards of service and professionalism in all interactions.

By agreeing to this Agreement, you acknowledge and accept our approach to delivering unparalleled travel experiences.


4. Booking & Payment Terms

  1. Booking Confirmation
    • A booking is confirmed only when the Client submits a signed booking form and pays a non-refundable deposit of 30% of the total package cost.
    • Full payment must be received no later than 45 days before the departure date.
  2. Late Bookings
    • For bookings made less than 30 days before departure, full payment is required immediately upon confirmation.
  3. Payment Methods
    • Payments can be made via bank transfer, credit/debit card, or any other approved method. The Client is responsible for any associated transaction fees.
  4. Failure to Pay
    • The Agency reserves the right to cancel any booking due to non-payment within the stipulated deadlines. Cancellation charges as outlined in Section 5 will apply.

5. Cancellation & Refund Policy

Cancellation by the Client:

  • 60+ days before departure: Refund of all payments, less a 10% cancellation fee.
  • 30-59 days before departure: Refund of 50% of the total package cost.
  • Less than 30 days before departure: No refunds will be issued.

Cancellation by The Agency:

  • The Agency reserves the right to cancel or reschedule any tour due to unforeseen circumstances (e.g., Force Majeure or insufficient participation). In such cases:
    • Clients will be offered an alternative of equal or greater value.
    • If no suitable alternative is available, the Client will receive a full refund, excluding non-recoverable expenses with Service Providers.

6. Travel Documentation

  • The Client must ensure all travel documents (passports, visas, permits) are valid and meet destination requirements.
  • The Agency is not liable for denied entry, missed flights, or additional costs due to invalid or incomplete documentation.

7. Conduct & Safety

  • The Client must adhere to local laws, customs, and the instructions of tour leaders or guides.
  • Any illegal or disruptive behavior may result in the termination of services without refund.

8. Liability Disclaimer

  1. Third-Party Services
    • The Agency is not liable for the acts or omissions of Service Providers, including airlines, hotels, or transport operators.
  2. Force Majeure
    • The Agency shall not be liable for cancellations, delays, or disruptions caused by circumstances beyond its reasonable control.

9. Amendments to Terms

The Agency reserves the right to amend these Terms and Conditions without prior notice. Updated terms will apply to all bookings made after the revision date.


10. Dispute Resolution

  • This Agreement shall be governed by the laws of India.
  • Disputes arising under this Agreement shall be resolved through arbitration as per the Indian Arbitration and Conciliation Act, 1996.

Acknowledgment

By confirming a booking, the Client acknowledges that they have read, understood, and agreed to these Terms and Conditions.
